Terms & Conditions
Please read the terms and conditions carefully before booking your session. Your session payment signifies acceptance of these terms and conditions as a legally binding contract.
Cancellation/ Postponement
The client acknowledges that the session fee is non-refundable in the event of cancellation by the client.
Session fees are transferable if a date change is necessary, however 48 hours’ notice is required, and postponement will be subject to the photographer’s availability.
Sessions can only be postponed by the client twice; if a session needs to be rescheduled a third time, the session fee will be forfeited.
If the appointment must be cancelled by the photographer due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the Client would like a Session Fee refund, this will be granted.
In the unlikely event that Twinkle Tots needs to cancel (and the session cannot be postponed to a new appointment) the full session fee will be returned to you .
Failure to Perform
If the Photographer cannot perform this Agreement due to a fire, illness, casualty, act of God, or other cause beyond the Photographer’s control, then the Photographer shall return to the Client any funds previously paid but shall have no further liability with respect to the Agreement.
This limitation on liability shall also apply in the event that photographic images are lost through camera or card malfunction, equipment theft, accident or any other circumstances beyond the Photographer’s control, liability is limited to funds paid only.
Photographing any specific moment is not guaranteed. Although all possible care will be taken to produce images of all important or special moments during the session, the Photographer cannot place an unconditional guarantee on the above.
Completion Schedule
Editing of images will be completed within 14 days from the date of the session.
Images will be available for viewing for 7 days via an online gallery of low-resolution watermarked proof images.
Images shown to the Client are at the discretion of the Photographer and images not shown as final proofs will be purged after the initial processing stage. The Client will not be given access to the unedited images from the photo session.
During the 7 day window the Client can choose their favourite images to be included in their chosen package from the online gallery. Please choose images carefully. Once print or digital products are prepared, designed or ordered, sales are final, and no refunds will be given. Due to the nature of photographic products, images/products cannot be returned.
After the 7 day period has passed, the gallery will be archived and an administration fee of £15 may be chargeable to reinstate access.
Please note that whilst Twinkle Tots aims to produce approx. 20-30 edited images from each Session (and 5-15 edited images for a Mini Session) this may not always be possible.
Online Gallery
The photographer cannot be held responsible for the quality of viewing online galleries, in regard to client screen size and detail, or accurate colour reproduction of their viewing device.
Clients do not have permission to screenshot, download or otherwise copy the images provided on the online gallery. Regardless of intent for use, this is considered a breach of copyright.
Copyright, Reproduction & Model Release
Copyright will always be retained by Twinkle Tots.
No image can be copied, scanned or reproduced in any form whatsoever without prior consent. This includes saving, screen grabbing and downloading from Facebook or other social media.
The Client agrees that they are 18 years or older, and are the parent/guardian of either selected, or any/or all persons under the age of 18 who are in any of the photographs.
Client Usage
The Client shall not alter the images from their original state as delivered by the Photographer; may not use the images in competitions, exhibitions or for any commercial use without prior written consent of the Photographer; and shall not publish any images without the prior written consent of the Photographer, with the exception of personal online sharing.
Image Production
Twinkle Tots fully edits all images before presenting to the client and non-permanent minor scratches, bruises and blemishes will be removed during processing.
An editing fee of £10 per photo will apply for any editing requested by the Client that is outside the realm of normal editing, depending on the extent of the work.
The Photographer will edit the images in either colour or black & white depending on which suits the image best and to the discretion of the Photographer. If the Client wishes to purchase an image in an edit not shown, the cost is £10 per photo to cover additional editing.
Image Storage & Archiving
Following delivery, your online gallery will remain available for a minimum of 12 months unless otherwise stated.
It is the client’s responsibility to download and securely back up all purchased digital images during this period. While Twinkle Tots Photography takes reasonable care in storing image files, long-term archiving cannot be guaranteed.
Once the gallery has expired, or after 12 months from the date of delivery (whichever is later), image files may be permanently deleted without further notice to free storage space. After this point, Twinkle Tots Photography cannot guarantee that images will be available for re-delivery, replacement, or future purchase.
Clients are strongly encouraged to keep multiple backups of their digital images (for example, on a computer, external hard drive, and cloud storage), as digital files can be lost or corrupted over time.
Prints
All images produced by Twinkle Tots are done on a fully calibrated monitor, and all prints ordered directly through Twinkle Tots will be a true reflection of the editing carried out.
Twinkle Tots will not be held responsible for variances in images caused by clients viewing images on non-calibrated screens, monitors or poor-quality printing.
Use of Pictures
At times, Twinkle Tots may use session images for the purpose of sales, advertising, or promotion on it’s business website or social media.
Posts will not include names or any personal information about the subject(s). If you do not wish to have your images shared, please email georgia@twinkletotsphotography.co.uk
Camera Policy
Cameras, camera phones, camcorders or any other recording equipment (outside of those being used by the Photographer) are not permitted during any session due to the distraction it can cause.
Prices
All prices are subject to change without notice by Twinkle Tots (outside of session).
No consideration will be given to previous client experience regarding product pricing, availability, package structure, or session fees.
Privacy
Twinkle Tots will never share, or allow to be accessed, shared or distributed, any personal or contact information of any client or enquiry obtained by any means.
